Terms of Service

Last Updated: September 1st, 2026

1. Introduction and Acceptance of Terms

Welcome to Tutordue. These Terms govern your access to and use of our website and services. By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and all operating rules. If you do not agree, you must not use the Service.

2. Account Registration, Age Eligibility, and Security

2.1. Age Requirement (18+) and Minor Representation

You must be at least 18 years old to register an independent account, make purchases, or handle financial transactions on Tutordue.

If an account is created by or for a user under the age of 18 ("Minor"), the individual registering the account explicitly represents and warrants that they are doing so under the direct guidance, authorization, and supervision of their parent or legal guardian. Any financial transactions, purchases, or billing events processed through a minor account are conclusively deemed authorized by the parent or legal guardian, who assumes full financial and legal liability.

2.2. Data Accuracy and Identity Protection

To maintain marketplace security, Tutordue operates under an Identity Obfuscation Framework. Users must use public usernames and selected educational tiers. Displaying real full names, direct phone numbers, or social media handles on public dashboards is strictly prohibited.

2.3. Credentials and Security Operations

You are solely responsible for maintaining the confidentiality of your credentials and assume complete liability for all activities under your account. Notify us immediately of any unauthorized access at support@tutordue.com.

2.4. Child Protection and Mandatory Conduct Rules

Because the Service hosts minor learners within virtual spaces, all users must adhere to strict safety protocols:

  • No Off-Platform Communication: All interactions, file transfers, and video sessions must take place exclusively through the Tutordue dashboard. Sharing private emails, phone numbers, or external links is strictly banned.
  • Prohibited Contact: Arranging unmonitored digital meetings or physical real-world meetups outside the platform is strictly forbidden and results in a permanent ban.
  • Safety Monitoring: Tutordue reserves the right to review session metadata and chat logs to ensure user safety. Harassment targeting minors results in immediate account termination, forfeiture of escrow balances, and law enforcement reporting.

3. Marketplace Operations and Transactions

3.1. Tutordue as a Marketplace

Tutordue connects students with tutors and facilitates digital product sales. We are not a direct service provider. Contracts for tutoring are directly between the student and tutor, backed by our escrow system which holds payments and releases them upon successful service delivery.

3.2. E-commerce Store and Digital Deliverables

All products sold are delivered in digital formats. If a buyer encounters a corrupt file or severe technical failure, they may file a formal report within 72 hours for potential escrow review and refund.

3.3. Quality Control and Prohibited Conduct

  • Academic Dishonesty: Gigs and educational services must follow ethical guidelines and institutional standards.
  • Off-Platform Payments: Attempting to bypass PayChangu to avoid platform fees will result in an immediate permanent ban.

4. Payments, Billing, and Subscriptions

All financial transactions are handled securely via third-party processor PayChangu. We do not store full credit card data. Tutors agree to platform transaction fee deductions. Subscription renewals continue automatically until cancelled via account settings, with no refunds for unused portions.

5. User-Generated Content

You are solely responsible for content you upload ("User Content"). You grant Tutordue a non-exclusive, worldwide, royalty-free license to use, store, and display such content to operate and promote the Service.

6. Intellectual Property Rights

All platform content (excluding User Content) is the property of Tutordue. You are granted a limited, non-exclusive license for personal, non-commercial use only.

7. Third-Party Services and Data Sharing

We integrate with trusted third-party providers (e.g., PayChangu, analytics tools) for core platform operations as outlined in our Privacy Policy.

8. Disclaimers and Limitation of Liability

DISCLAIMERS

THE Tutordue SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE OR ACCURACY OF USER PROFILES.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Tutordue SHALL NOT BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $100.00 OR THE AMOUNT PAID BY YOU IN THE LAST 12 MONTHS.

9. Indemnification

You agree to defend and hold harmless Tutordue from any claims, liabilities, or expenses arising from your violation of these Terms or your interactions with other users.

10. Termination

We may terminate or suspend your account immediately for any breach of these Terms. Upon termination, your right to use the Service ceases instantly.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Malawi. Legal actions must be brought in competent courts located in Malawi. Disputes will be resolved through negotiation, mediation, and binding arbitration on an individual basis (class-action waiver applies).

12. Changes to These Terms

We reserve the right to modify these Terms at any time with reasonable notice for material changes.
